The aim of this new chronicle, which is devoted to the international organisations’ work regarding international commercial law, is to outline what’s new in this significantly developing law by which is noted for the plurality and the richness of its soft law and informal sources. Therefore it outlines the development of specific international commercial rules, which go largely beyond the initial rules, which were, by the mechanism of conflict of law, a mere projection of domestic rules, or a slight adaptation of them -as for direct material rules. The informal nature of the rules and mechanisms we will study does not, in any way, diminish the influence of international institutions which have created the said rules (associations, international organizations, etc.…) or of the resources elaborated by the latter (model contracts, declarations, recommendations, etc…) on international commercial businesses. In addition, some of the mentioned resources are inclined to go beyond the informal sources stage, which in some cases remain a mere intermediary state of the international commercial law sources.
In this first publication chronicle, the work conducted by the World Bank and the IMF, the OECD, the International Chamber of Commerce and the UNCITRAL are analysed. |
