The increasing popularity of adjudication has led to much recent debate about when and how adjudication decisions should be enforced. In England, courts have generally been ready to grant immediate enforcement of adjudicator’s decisions, even where they remain subject to challenge. The article examines the extent to which arbitrators, particularly under the FIDIC suite of contracts, have followed the same approach and considers whether they should continue to do so.
